I checked as many resources as I could find and was not able to find anything conclusive about the vintage of your diamond point chisel. Personally, if I were you, I would put it in my set until such time as new evidence emerges that would allow it to be dated conclusively. The first thing that I look for to rule out any punch or chisel is the warning about using protective eyewear and I'm assuming that the warning doesn't appear on your chisel.

Thank's for checking none of the New Britain have the warning on them,I also have a Blackhawk with the = before & after= the brand name.I remember reading a post about the underlined Craftsman wrenches being war time and the one's marked with the = = being post war, I just don't know if that pertained to the Craftsman tools only or all across the other brand's ? I will post a picture of them,maybe others will chime in.By the way have you ever seen a pair of Utica No 7-B pliers? I have sent a pic to a couple of members they are pre war but they do exist would like to get more feed back on them,Have Utica No7-C also I will post a pic of the Utica No 7-B this evening.

Those Utica pliers are really neat! If the 7-C are considered early war, the 7-B would surely have to be pre-war. I don't know enough about them to say one way or another, but I wouldn't let those go, ever. Never seen a pair of those before. Too cool.

For what it's worth, I think your intuition - relevant to the Craftsman markings - is good, and I would tend to think the marking style was consistent across the New Britain empire, as always. The markings on the chisels (and the DOEs, and DBEs, and pliers, etc etc) are the same in the 1940, 1953, and 1959 catalogs. No = = marks showing. Having said that, I don't always trust catalogs for being accurate with respect to markings. Some vintage ads might help.
By the way, I thought the SAFETY WARNINGS came in with OSHA in 1970, so the lack of them is really not much help at all in dating chisels without them to wartime, except, as Don says, as an immediate "move on" flag when pawing through a box. I could be wrong about that.
